1. Agreement to Terms
By accessing and using the services provided by Grow with Marketa, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time.
2. Service Description
Grow with Marketa provides digital marketing and lead generation services through three primary service tiers:
- Presence Plan (PKR 20,000 / $90/month): Social media management and basic ad management for small businesses
- Lead Engine Plan (PKR 45,000 / $161/month): Comprehensive lead generation with Meta ads management and WhatsApp integration
- Performance Plan (PKR 75,000 / $269/month): Full-service marketing with aggressive lead generation and priority support
Add-on services, such as custom landing page design (PKR 10,000), are available with any plan.
3. Performance Guarantee
Our Lead Engine and Performance plans include a performance-based guarantee:
- For Lead Engine: Target of generating qualified leads as outlined in your service agreement
- For Performance: Customized lead generation targets based on your industry and goals
- If guaranteed results are not achieved within the specified timeframe, we will continue service at no additional charge until results are delivered
Ad budget costs are paid directly by the client and are separate from service fees.
4. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your business and goals
- Pay service fees on the agreed schedule (typically monthly)
- Pay advertising budget costs directly to ad platforms (Meta, Google, etc.)
- Provide necessary access to your business accounts and platforms
- Respond promptly to our requests for information or approvals
- Comply with all applicable laws and platform policies
5. Our Responsibilities
Grow with Marketa commits to:
- Deliver services according to your selected plan
- Manage campaigns professionally and ethically
- Provide regular reporting and updates on campaign performance
- Use industry best practices and proven strategies
- Maintain confidentiality of your business information
- Respond to inquiries within 24-48 business hours
6. Payment Terms
Service fees are due on the first of each month or as specified in your service agreement. Payment methods and additional terms will be outlined in your contract. Late payments may result in service suspension.
Advertising costs are billed separately by the advertising platforms and are your direct responsibility.
7. Cancellation and Refunds
Clients may cancel services with 30 days written notice. Refunds are provided on a pro-rata basis for unused service periods. No refunds are provided for advertising spend, which is controlled by third-party platforms.
8. Limitation of Liability
While we strive to deliver excellent results, we cannot guarantee specific outcomes due to factors beyond our control, including:
- Market conditions and competition
- Platform algorithm changes (Meta, Google, etc.)
- Client business decisions and product/service quality
- Third-party service disruptions
Our liability is limited to the service fees paid in the preceding 30 days.
9. Intellectual Property
Content, strategies, and deliverables created by Grow with Marketa remain our intellectual property unless otherwise specified in your service agreement. You retain ownership of your business information and brand assets.
10. Prohibited Activities
You agree not to use our services to:
- Violate any applicable laws or regulations
- Promote illegal, fraudulent, or deceptive products/services
- Create misleading advertising content
- Engage in unethical marketing practices
- Violate third-party intellectual property rights
- Harass or harm individuals or groups
11. Confidentiality
We maintain strict confidentiality of your business information and campaign strategies. This information will not be shared with competitors or third parties without your explicit consent, except as required by law.
12. Dispute Resolution
Any disputes arising from these terms or our services will be resolved through negotiation. If negotiation fails, disputes will be resolved through arbitration or legal proceedings in Lahore, Pakistan.
13. Changes to Terms
We may update these Terms of Service at any time. Continued use of our services after such updates constitutes acceptance of the new terms. For significant changes, we will provide notice via email or website notification.
